THE KANSAS TIER II ONLINE REPORTING SYSTEM IS OPEN. CLICK THE REGISTERED USERS LINK TO BEGIN.

Payment can be made by check, money order, or credit card. Visa, MasterCard, Discover, or American Express are accepted. Go to https://www.kdhe.ks.gov/1129/Right-to-Know-Regulations-Reporting for a credit card payment form. Make checks payable to: KDHE.

ATTENTION USERS: SERVER DATA UPDATES ARE SCHEDULED FOR THIS TIER II WEBSITE EVERY THURSDAY AT APPROXIMATELY 4:30PM. YOUR INFORMATION WILL BE INACCESSIBLE DURING THIS 4-HOUR PROCESS.

If you have a User ID and Password and would like to complete the Kansas Tier II, you must click o­n the Registered Users button in the upper left-hand corner to log o­n. If you do not have a User ID and Password, they can be obtained by contacting the Right-to-Know Program at kdhe.rtk@ks.gov.

Facilities utilizing the web site to file their Tier II report must generate a Fee Calculation Worksheet(s) and Certification Statement Letter. These documents must be mailed to KDHE with the appropiate fees (or credit card payment form) by March 1 to complete their reporting requirements. If paying by credit card, the documents can be emailed to kdhe.rtk@ks.gov. The credit card payment form can be found at the link listed above. If you wish to include a site plan then a hard copy will have to be enclosed with your submission.

Facilities must also print a Tier II report using the PDF generator o­n their facility data page and submit a copy to their Local Emergency Planning Committee and local Fire Department.

WHO MUST SUBMIT THIS FORM?

The owner or operator of a facility where extremely hazardous or hazardous chemical substances are used, produced, or stored must submit Tier II information if the quantity of hazardous chemicals o­n hand exceeds specific thresholds (see below).

WHAT CHEMICALS ARE REPORTED?

Hazardous chemicals that must be reported include any substances for which your facility must prepare or have available Safety Data Sheets (SDS) under OSHAs Hazard Communication Standard 1910.1200. If your facility has more than 10,000 pounds of a hazardous chemical o­n hand at any o­ne time during the calendar year, the chemical must be reported o­n the Tier II.

Extremely hazardous substances (as specified in 40 CFR Part 355) must also be reported o­n the Tier II form if a facility has more than 500 pounds or the threshold planning quantity, whichever is lower, o­n hand at any o­ne time during the calendar.
